Business Innovation and Investment (Provisional), subclass 188

THIS VISA HAS FOUR STREAMS:

  1. BUSINESS INNOVATION: Owners who want to relocate their overseas business or establish a new business in Australia.
  2. BUSINESS INVESTEMENT: Successful investors or business owners willing to invest a minimum $1,500,000 in Australia for four years.
  3. SIGNIFICANT INVESTOR: People willing to make a significant investment (at least $5,000,000)in Australia for four years.
  4. PREMIUM INVESTOR STREAM: People willing to invest at least $15,000,000 into complying premium investments in Australia.

This provisional visa valid for 4 years is part of a two-step pathway to permanent residency.
After having maintained an investment or established a business in Australia eligible applicants will be able to apply for Business Innovation and Investment (Permanent), subclass 888.

CRITERIA

1Common criteria (Primary Applicant):

  • Nominated by a state or territory government (does not apply to Premium Investor stream)
  • Less than 55 years of age (unless the nominating state or territory
    certifies that the applicant will make an exceptional economic benefit)
  • Has a successful business and/or investment history
  • Has adequate personal and business assets
  • Scores at least 65 points on the innovation points test

2Business Innovation stream criteria:

  • Total personal and business assets of at least $800,000
  • Ownership of a business with a total annual turnover of at least $500,000 in at least two of the last four fiscal years

3Investor stream criteria:

  • Total personal and business assets of at least $2,250,000 for the two fiscal years
  • At least three years experience of direct involvement in managing one or more qualifying businesses or eligible investments
  • Make an investment of $1,500,000 in Australian State or Territory bonds prior to grant of the visa
  • For at least one of the last five fiscal years either:
  1. Managed eligible investments of at least $1,500,000, or
  2. Managed a qualifying business in which hold at least 10% shares

4Significant Investor stream criteria:

  • Total net assets of at least $5,000,000
  • Make an investment of $5,000,000

5Premium Investor stream criteria:

  • Austrade nomination on behalf of the Australian government
  • Total net assets of at least $15,000,000
  • Make an investment of $15,000,000

6Main criteria (primary applicant and all members of the family unit):

  • No substantial criminal record
  • Good health

Business Innovation and Investment (Permanent), subclass 888

CRITERIA

1Common criteria (Primary Applicant):

  • Hold Business Innovation and Investment (Permanent), subclass 888 (or Special Category visa, subclass 444 if applies under Business Innovation stream)
  • Nominated by a state or territory government or Austrade (Premium Investor stream)
  • Continue to own and manage a business or investment activity in Australia
  • Satisfactory compliance with applicable Australian Commonwealth, State and Territory laws

2Business Innovation stream criteria:

  • Been in Australia for at least 1 of the last 2 years
  • Had an ownership interest in an Australian business for the last 2 years
  • Obtained ABN and lodged Business Activity Statements for the last 2 years
  • Business with turnover of at least $300,000 for the last 12 months (requirement may be waived by a state or territory government if business operates in a regional area)
  • Demonstrate that achieved at least two of the following requirements:
  1. A net value of business assets of at least $200,000
  2. A net value of personal and business assets of at least $600,000
  3. Employment of at least two full-time employees who are not relatives but who are Australian permanent residents, citizens or NZ passport holders

3Investor stream criteria:

  • Been in Australia for at least 2 of the last 4 years
  • Maintained the $1,500.000 investment for at least 2 of the last 4 years

4Significant Investor stream criteria:

  • Been in Australia for at least 40 days per year
  • Maintained the $5,000.000 investment for at least 4 years

5Premium Investor stream criteria:

  • Been in Australia for at least 1 year
  • Maintained the $15,000.000 investment for at least 1 year and for the entire time while holding Business Innovation and Investment (Provisional) visa, subclass 188.

6Main criteria (primary applicant and all members of the family unit):

  • No substantial criminal record
  • Good health

Business Talent, subclass 132

THIS VISA HAS TWO STREAMS:

  1. SIGNIFICANT BUSINESS HISTORY STREAM: High-calibre business owners.
  2. VENTURE CAPITAL ENTREPRENEUR STREAM: People who who have sourced venture capital funding from a member of the Australian Venture Capital Association Limited

This is a permanent visa.

CRITERIA

1Significant Business History stream criteria:

  • Nominated by a state or territory government
  • Less than 55 years of age (unless requirement is waived)
  • Has a successful business history
  • Has business assets of at least $400,000 for at least 2 of the last 4 fiscal years and
    10% ownership of the business, if it is a publicly listed company
  • Net business and personal assets of at least $1,500,000
  • Business with a total annual turnover of at least $3,000,000 in at least 2 of the last 4 fiscal years

2Venture Capital Entrepreneur stream criteria:

The applicant has received at least $1,000.000 in funding from an Australian venture capital firm. The funding must be for the start-up, product commercialisation or business development of a promising high-value business idea.

3Main criteria (primary applicant and all members of the family unit):

  • No substantial criminal record
  • Good health
